Power of Attorney
If a Power of Attorney has been appointed to manage legal and financial decisions for another, and they are required to act in certain land transactions, the document must be registered with NSW Land Registry Services (LRS). Our office is equipped to assist our clients with lodging the Power of Attorney with LRS. Upon lodgement, the Power of Attorney is stamped within a Lands book and number reference, allowing settlement to take effect.
Caveats and Mortgages

A caveat acts as a warning to a third party that the Caveator has an interest in the land. A caveat will prevent the owner of the land from transferring, selling, or another type of dealing over the property without the prior consent of the Caveator. The registered proprietor is also entitled to lodge a caveat on their property to confirm their interest in the land, and is a popular choice when a mortgage is not required or registered on the title.

A Mortgage is similar to a caveat but is a more secure and enforceable type of loan security. The mortgagee holds the Control of the Right to Deal and consent must be provided by the mortgagee if the registered proprietor wishes to sell, transfer or otherwise deal with the property.
